SARB for Staff


A SARB referral is made after the school site sends a series of attendance letters with interventions taking place between each letter. When the school has exhausted all of its resources and attendance has not improved, a SARB referral may be submitted.
 
SARB Attendance Letters
Interventions must be implemented and documented between each letter. The San Diego Juvenile Court will not consider period absences or tardies (W's or T's). Unverified absences (A) are not counted for a SARB referral because they are not verified absences.
  1. Attendance Warning Letter  - not a requirement for SARB process, but a good tool for very early intervention.  Sent at site's discretion for any combination of absences and/or tardies
  2. Notification of Truancy   - sent for any combination of 3 U, Z and/or W codes for periods of 30 minutes or more.
  3. Second Notification of Truancy (Habitual)  - sent only for 6 full day unexcused absences or truancies (U or Z code only).  Must hold parent conference at this time per Education Code
  4. Third Notification of Truancy and Referral to SARB  - sent for more than 6 full day U or Z codes.  Do not send this letter until you are prepared to send a SARB Referral since the letter informs parents they are being referred to the SARB Department
School sites must conduct a SART meeting prior to referring the case to SARB.  Please make sure this intervention is done.  A good time for a SART meeting is when the Second Notification of Truancy is sent out because the Ed Code requires a parent conference at that time.
 
Please do not send out these letters on the same day or without enough time in between for an intervention to occur.  SARB cannot accept cases when letters are sent out back to back without further full day absences AND interventions in between each letter.
 
Referral Requirements
When a referral is made to the SARB office the following documents, if applicable, should be provided:
  • SARB Referral Form must be completely filled out or it may be rejected
  • Attendance letters (First, Second and Third Notification of Truancy letters are required)
  • Site interventions/incentives must be documented, including any agency referrals and whether parent/student followed through with referral 
  • Nurse's interventions/letters, if applicable
  • Conference dates with parent/guardian (mandatory at the time the Second Notification of Truancy letter is sent or hand delivered) 
  • SART contract or any other meeting documents (SST, etc.). (SART Agmt is under "Forms and Reference" on this site)
  • IEP (must be current and should address attendance), if applicable
  • Community agency involvement, if appropriate

Truancy Court Case Filing Guidelines
When a student continues to have ongoing unexcused absences (U or Z only) following the SARB hearing, the school site should contact the SARB office for possible judicial intervention.  The District Attorney’s office is specific in their requirements for cases submitted to them and all of the following guidelines must be followed:

  • All SARB procedures must be followed
  • The minor must be no older than 16 years old at the time of the court referral
  • The minor must be severely, habitually truant with full day unexcused absences
  • Full day excessive absences are required. Period truancies and tardies (T and W) are not counted
  • A home visit should have been conducted by school site if student is not attending
  • Recent address verification of the minor’s legal residence within the district is a requirement
  • All on-site interventions and placement adjustments should be exhausted, including pre-SARB contracts, SST’s, SART’s, etc.
  • Interventions must be done between each letter (do not send attendance letters out on the same dates without time for interventions)
  • Letters and the SARB contract must be in the parents’ home language.
  • Special education students can be referred if their disability does not prevent them from attending school regularly.  This should be addressed and documented prior to the SARB hearing.

A SARB hearing will be scheduled within two to three weeks and you will be notified of the hearing date, time and location upon approval of a SARB referral.  A school site representative familiar with the case is required to attend the hearing.
