Brief Explanation:

In 1999 the Office for Civil Rights (OCR) visited twelve schools to check for compliance with the SPEDLEP Corrective Action Plan. At that time, representatives from OCR questioned staff members about the process used for articulation between school levels. OCR concluded that at some sites there appeared to be no procedure for communication between the IEP team members of the sending and receiving schools during the articulation process. In the agreement reached with OCR, the district agreed to review a random sampling of IEP containers at middle level and high schools to determine that schools include special education in their established articulation processes. The district also agreed to send a circular to schools as a reminder to follow the processes during articulation for the coming school year.

Site administrators are asked to ensure that special education representatives are included at all articulation meetings at both the sending and receiving schools. If students are scheduled to visit and tour the middle schools or high schools, special education students are to be included. In addition, steps should be taken to ensure that SPEDLEP students have bilingual, ESL, and ELD needs met.

Teachers, counselors, and case managers are to ensure that the full range of options is considered when developing a student's IEP and program, that students are placed in the least restrictive environment, and finally that special education students' programs meet all requirements of the IEP.
