Action Requested: Discontinue release of state Standardized Testing and Reporting (STAR) Program results to anyone other than school personnel and parent/guardian without written parent/guardian permission

Brief Explanation:

The California Department of Education has issued a legal opinion that a school district, county office of education, or charter school may not make STAR test results an integral part of a student transcript. If a parent or pupil does not consent to the inclusion of STAR test results on the transcript, a school district, county office of education, or charter school cannot have the transcript issued to third parties with the STAR test results included. The Office of the General Counsel, San Diego Unified School District, has issued the opinion that "a student’s results from a STAR test can be placed on a student’s transcript only when there is written parental or guardian consent, if the student is a minor, or with the written student’s consent, if the student has reached the age of majority or is emancipated."

Effective March 28, 2001, STAR testing results will no longer print on the Transcript program, however they will continue to be available on the Student Profile program. "Old" transcripts containing STAR test results and Student Profiles containing STAR test results are for internal use only and are not to be distributed to anyone outside of the district without the express written permission of the parent/guardian or, if the student is 18 years of age, the student. Furthermore, schools receiving requests for student cum records from third parties other than schools must ensure that no STAR test results are transmitted without the express written permission of the parent/guardian or, if the student is 18 years of age, the student. Student Profiles may be provided to parents/guardians or students upon request.

It is highly recommended that schools reprint Transcripts for all 11th and 12th grade students immediately and that they order reprints for individual students at other grade levels as requests are received.
