Brief Explanation:

Section 504 of the Rehabilitation Act of 1973 and the Americans with Disabilities Act prohibits discrimination against persons with a disability in any program receiving federal financial assistance or any public entity respectively. Section 504/ADA defines a person with a disability as anyone whom:

Has a mental or physical impairment which substantially limits one or more major life activities such as caring for one’s self, performing manual tasks, walking, seeing, hearing, speaking, breathing, learning and working; has a record of such impairment; or is regarded as having such impairment.

The school district has specific responsibilities under the Rehabilitation Act of 1973 that include identifying, evaluating, and if the child is determined to be eligible under Section 504, providing access to appropriate educational services. It is our responsibility to identify students who may qualify for services. The Student Study Team (SST) shall be utilized as the K-12 process for identifying unserved children.
