Teachers' Contract Extended To June 30, 2003
5 Percent Salary Increase Payable in September

Teachers will receive an additional 5 percent salary increase in September as a result of a tentative agreement reached by the district and the San Diego Education Association Tuesday that also extends the current teachers’ contract to June 30, 2003. The existing contract was due to expire June 30, 2001.

Under terms of the existing contract with SDEA, teachers were scheduled to receive the 5 percent increase, retroactive to July 1, 2000, next spring on top of a 3 percent increase that became effective July 1. "This is excellent news for our teachers and the district," Board of Education President Edward Lopez said. "We can look forward to three years of labor peace with our largest employee union, which means each one of us can focus on the job at hand – our back-to-basics reform, and teaching and learning in the classroom."

The tentative agreement, which must be approved by SDEA and ratified by the Board of Education, also outlines salary increases for the 2001-02 and 2002-03 school years.

The agreement guarantees that salary increases will be provided in these years based on the amount of money allocated by the state under the cost of living adjustment. A formula will be used to determine the exact percentage of salary increase to be paid to teachers after costs associated with maintaining the salary schedule and maintaining existing medical, dental and vision insurance are determined and deducted from the total COLA state funding that the district receives.

As of press time Wednesday, Aug. 30, discussions were under way with representatives of all other employee organizations for similar contract extensions that would result in 5 percent increases payable in September – and retroactive to July 1 – for virtually all district employees.

Here is the complete text of the tentative agreement:

MEMORANDUM OF UNDERSTANDING

For the
REFORMATION (EXTENSION) OF THE TERM OF THE CURRENT COLLECTIVE NEGOTIATIONS CONTRACT TO JULY 1, 2000 THROUGH JUNE 30, 2003

The parties hereby agree that the term of the existing Collective Negotiations Contract between the Board of Education of the San Diego Unified School District and the San Diego Education Association (July 1, 1998 through June 30, 2001) is hereby reformed (commonly referred to as a "roll-over" or "extension") to a new three year term, beginning July 1, 2000 and continuing through June 30, 2003. The purpose of this Memorandum of Understanding is to set forth the terms and conditions under which establishment of this new Contract term shall occur.

1. The parties acknowledge that funds allocated by the State to eliminate the deficit to the District’s revenue limit in the 2000-2001 school year ("deficit reduction money") will not be received by the San Diego Unified School District ("District") until early spring 2001. Notwithstanding this time line, the parties agree that:

A. Effective July 1, 2000, the 1999-2000 salary rates shall be increased by three percent (3%) previously agreed to by the parties, plus an additional five percent (5%) in reflection of deficit reduction money to be received for 2000-2001 for a total eight percent (8%) salary rate increase.

B. Regarding the 1.45% salary increase already granted to unit members in the spring of 2000 based on estimated deficit reduction money received by the District for 1999-2000: If August 2000 recalculations result in an amount greater than 1.45%, the difference, if any, will be added to the salary rate increase for 2000-2001 as determined by paragraph 1(A) above.

2. For the 2001-2002 and 2002-2003 school years, the District will provide a Revenue Limit-funded Cost of Living Adjustment (COLA) compensation package as follows:

A. Following adoption of the State Budget, calculate the projected average daily attendance (ADA) using the enrollment as of the end of the fourth week of the traditional school year. Using this projected ADA, calculate the Revenue Limit-funded Cost of Living Adjustment (COLA), expressed in dollars, to be used for all employee compensation package costs in each year.

B. Determine the additional cost of maintaining the existing salary schedules for all employees based on comparison of the prior two years J90 format salary matrix prepared as of June 1 for each additional year. Deduct this dollar amount from the COLA dollar amount calculated in 2(A).

C. Determine the additional cost of maintaining the existing employee benefits (medical, dental, vision) for all employees and deduct this dollar amount from the figure calculated in 2(B).

D. Calculate the salary base for all employees including the variable benefits.

E. Divide the remainder as determined in 2(C) by the salary base calculated in 2(D) for all to determine the percentage by which salary rates will be increased retroactively to July 1 of that school year. The salary schedule will increase unless mutually agreed to by the parties.

F. Regarding the 5% salary increase negotiated in the fall of 2000 for unit members based on estimated deficit reduction money received by the District for 2000-2001: If August 2001 recalculations using the agreed upon process for 1999-2000 result in an amount greater than 5%, the difference, if any, will be added to the salary rate increase for 2001-2002 as determined by paragraph 2(E) above.

3. Article 7, Section 7.1.4 of the 1998-2001 Collective Negotiations Contract shall be included in the new 2000-2003 Contract, and shall apply to any revenue limit deficit reduction funds or equalization aid funds received by the District during the term of such new contract.

4. Article 7, Section 7.2 (all subsections) of the 1998-2001 Collective Negotiations Contract shall be included in the new 2000-2003 Contract, and shall apply to any additional funds (as defined in Section 7.2.1.1) received by the District during the term of such new Contract excluding 9.8.2.

5. Implementation of the salary rate increase provided herein shall be consistent with the parties’ Memorandum of Understanding dated June 27, 2000 entitled, "Implementation of Beginning Teacher Salary Provision (AB1117)."

6. This agreement is explicit in stating changes to the Collective Negotiations Contract. Agreements reached during the term of the July 1, 1998 – June 30, 2001 agreement shall be included in the new agreement.
