Section 409A of the IRS Code and Deferred Compensation
There has been confusion and a number of questions regarding a new IRS regulation (Section 409A) and how it relates to deferred compensation (this section does not apply to qualified plans such as 401k, 403b or 457b). This section refers to non-qualified employee compensation that is deferred to subsequent tax years when earned in previous tax years. That means employees who work partial years and are paid over 12 months. This new regulation is not applicable to SDUSD employees because we pay in advance of the assignment (July 1 accrual each year with employee work years beginning in August/September). Therefore, no compensation is deferred to a subsequent tax year.
