Overview
The Labor Compliance Program plans, develops and coordinates the district's labor compliance program for public works contracts. The Program functions under the authority of the Board of Education, California Labor Code and Title 8 of the California Code of Regulations.
Primary Program Functions
- Ensure district compliance with state and federal prevailing wage laws and regulations.
- Provide technical assistance in the areas of prevailing wages, employment of apprentices and monitoring of the district's public works contracts ($25,000 or greater for construction and $15,000 or greater for alteration, demolition, repair or maintenance work).
- Operate an approved labor compliance program. The program, in operation since September 14, 2000, received final approval on March 15, 2002.
Training
The Labor Compliance Program conducts monthly workshops for contractors/subcontractors regarding compliance requirements to follow to remain compliant and reduce the risk of delays and formal withholds.
All workshops will be held at the Maintenance and Operations Center, 4860 Ruffner Street, San Diego, CA, 92111, in Training Rooms A & B from 1:00 to 3:00 p.m.

Agreement to Train Apprentices (DAS7)
This form is required of any employer of an apprenticable craft to prove that the contractor is authorized by a training program and the state to participate in the training of apprentices. Without this registration, a contractor can not comply with the Labor Code requirement to hire and train apprentices on public works projects. This form needs to be supplied once per apprenticeable classification, as authorized by Labor Code § 1777.5.
Apprentice Agreement (DAS1)
This form proves that a person claimed to be an apprentice is registered with an approved training program and with the California Division of Apprenticeship Standards, as required by Labor Code § 1777.5. This form must be submitted for each individual claimed to be an apprentice, or the contractor must pay the person journeyman wages.
Contractor Fringe Benefit Statement
The prevailing rate is determined by a basic rate of pay plus employer payments. Employer payments must indicate the hourly benefit amounts and to whom the benefits were paid on the fringe benefit statement for each classification. The fringe benefits are added to the basic rate of pay reported on certified payrolls to determine the prevailing wages paid to employees.

A contractor on a public works project must employ one (1) hour of apprentice work for every five (5) hours performed by a journeyman.
All contractors must register for dispatch of an apprentice from an apprenticeship program (for each apprenticeable craft or trade) by giving the program actual notice of at least 48 hours (business days only) before the date on which apprentices are required. If in response to a written request an Apprenticeship Committee does not dispatch any apprentice to a contractor who has agreed to employ and train apprentices within 72 hours of such request (business days only), the contractor shall not be considered in violation of failure to employ apprentices for the remainder of the project.
Contractors who are not already participating in an approved program and who did not receive sufficient number of apprentices from their initial request must request dispatch of apprentices from at least one other apprentice committee, if more than one exists in the area of the public works project."
