Permanent certificated employees who received a possible lay-off notice  have the right to request a hearing in front of an Administrative Law Judge. A request for hearing must be in writing and must be delivered to 4100 Normal Street, Room 2148, San Diego, California, 92103, on or before March 25, 2008. Certificated employees who submitted a request for a hearing will receive a Statement of Hearing Rights  and the following documents as required by law:

• Statement of Cause for Termination of Services 
• Notice of Defense 
• Notice of Hearing 

The California Education Code and other authorities require that notices provided to certificated employees contain specific language. The documents do not account for the important role that the affected certificated employees play in the lives of students and do not acknowledge the value of service to the district.

Each document should be reviewed carefully as they affect employee rights. Noticed employees will have re-employment rights for 39 months.

It is the district’s hope that the budget situation will improve and it will not be necessary to implement these actions.
